Official Rules

By entering the ClassOf1 Back to School Sweepstakes (the “Sweepstakes”), you agree to abide by these Official Rules. The Sweepstakes is subject to all applicable federal, state, and local laws. The ClassOf1 Back to School Sweepstakes is void where prohibited, regulated or restricted by law.

1) SWEEPSTAKES ENTRANCE AND AWARD

To enter, log onto www.ClassOf1.com and fill out the sweepstakes form completely. Only entries filled out completely will be considered. ClassOf1 will make a random drawing from among all eligible entries to identify four winners, who will be notified via email to them and via posting on the website on December 10, 2008. Odds of winning will depend on the total number of entries received.
Restricted to one entry per participant.

2) SWEEPSTAKES PERIOD

The Sweepstakes Period (“Sweepstakes Period”) is from 12:00 a.m. PST on August 20, 2008 to 11:59 p.m. PST on November 30, 2008. Entries received before or after the Sweepstakes Period are void and ineligible for the drawing.

3) ELIGIBILITY

No purchase is necessary. You are eligible to enter this Sweepstakes if you: Are a legal resident of the 50 United States or the District of Columbia; Are at least eighteen (18) years old at the time of entry; Are not employed by KUE Digital, Inc. or its affiliates (the “Sponsor”); and Are NOT an immediate family member (parent, child, spouse, sibling, and their respective spouses), of the Sponsor.

4) COMPLIANCE

This sweepstakes is void where prohibited, regulated or restricted by law, where a license is required or where subject to tax (other than tax on prizes awarded). All federal, state and local taxes are the sole responsibility of the winners.

5) PRIZES

Each entrant will be eligible to receive one of the four prizes offered. The prize received will depend solely on the results of the random drawing held by ClassOf1. The prizes are:
1) Apple MacBook Air 1800 USD*
2) Sony PlayStation 3 480 USD*
3) Microsoft xBox 360 350 USD*
4) Nintendo Wii 320 USD*
*Approximate retail value
The prizes will be shipped, at ClassOf1’s cost to the winners at the addresses included on the entrance forms. If the prizes are returned for being non-deliverable to the address provided, ClassOf1 reserves the right to award the prize to another entrant.
Other than as specified in these Official Rules, all fees and personal expenses incidental to redemption of prizes will be the sole responsibility of the winners. There will be no substitution or transfer of prizes except at the sole discretion of the sponsor. Other restrictions may apply.

6) PUBLICITY

Each winner must agree in writing that his or her name, likeness, and other information relevant to ClassOf1 may be used by Sponsor for promotional and publication purposes without additional compensation. Prior to receiving prizes each winner, or his or her legal guardian, will be required to sign a release provided by ClassOf1 or Sponsor to this effect.

7) CANCELLATION

ClassOf1 reserves the right to cancel or suspend the sweepstakes should any cause beyond the control of ClassOf1 affect the administration, security, fairness, integrity or proper operation of the sweepstakes, or for any other reason it deems appropriate, at its sole and absolute discretion.

8) GENERAL CONDITIONS

This Sweepstakes is governed by the laws of the State of Washington. You agree that the jurisdiction and venue for the handling of any disputes or actions arising out of this Sweepstakes shall be in the courts of the State of Washington without giving effect to any choice of law or conflict law rules (whether of the State of Washington or any other jurisdiction) which would cause the application of laws of any jurisdiction other than the State of Washington.

9) RELEASE

By acceptance of any prize, the winning entrant agrees to release, hold harmless and indemnify the Sponsor and its, suppliers, distributors, advertising/promotional agencies, assignees, licensees, attorneys, representatives and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt, use or misuse of any prize awarded herein.

10) UNLAWFUL CONDUCT AND DISQUALIFICATION

The Sponsor reserves the right, in its sole discretion, to disqualify any Sweepstakes entrant who the Sponsor determines, in its sole discretion, is (a) tampering with the entry process or the operation of the Sweepstakes or of any web site owned, operated or controlled by the Sponsor or its parent, subsidiary or affiliated companies; (b) ineligible to participate in the Sweepstakes for any reason, including based upon the entrant’s age, residency or failure to comply with these official rules; (c) submitting more than the allowed number of entries during the Sweepstakes Period; or (d) behaving in a disruptive manner or with intent to annoy, abuse, threaten or harass any other person.

11) LIMITATION OF LIABILITY AND REMEDIES

NEITHER THE SPONSOR NOR ANY OTHER RELEASED PARTY SHALL HAVE ANY LIABILITY WITH RESPECT TO ANY ENTRIES THAT ARE INCOMPLETE, LATE, GARBLED, MUTILATED, ILLEGIBLE,
DELAYED, MISDELIVERED, LOST, DAMAGED, STOLEN, DELETED OR LOST DURING TRANSMISSION, MISDIRECTED OR OTHERWISE NOT TIMELY OR ACCURATELY DELIVERED OR DIFFICULT TO INTERPRET OR UNDERSTAND. ENTRIES RECEIVED BY US THAT ARE INCOMPLETE, LATE, GARBLED, MUTILATED, ILLEGIBLE, DELAYED, MISDELIVERED, LOST, DAMAGED, STOLEN, DELETED OR LOST DURING TRANSMISSION, MISDIRECTED OR OTHERWISE DIFFICULT TO INTERPRET OR UNDERSTAND SHALL NOT BE ELIGIBLE FOR PRIZES AND WE WILL NOT DELIVER ANY NOTICE OF SUCH INELIGIBILITY TO THE PARTICIPANT.
UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL THE RELEASED PARTIES BE LIABLE FOR ANY DIRECT, INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, OR EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONJUNCTION OR CONNECTION WITH ENTRANTS’ PARTICIPATION IN THE SWEEPSTAKES, POSTING ON OR ACCESS AND/OR DOWNLOADING OF ANY MATERIALS OR INFORMATION FROM ANY WEB SITE OWNED, OPERATED OR CONTROLLED BY THE SPONSOR INCLUDING ITS PARENT, SUBSIDIARY OR AFFILIATED COMPANIES, AND/OR ANY PRIZE (INCLUDING, BUT NOT LIMITED TO, ITS ACCEPTANCE OR USAGE) AWARDED TO WINNERS IN CONNECTION WITH THE SWEEPSTAKES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY AND, TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAMAGES FOR BODILY OR PERSONAL INJURY, INCLUDING DEATH, EVEN IF THE RELEASED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSS. ENTRANTS AGREE THAT THE AGGREGATE LIABILITY, IF ANY, OF THE RELEASED PARTIES ARISING OUT OF ANY KIND OF CLAIM (WHETHER IN CONTRACT, TORT, OR OTHERWISE) SHALL NOT EXCEED $1.00.

12) INDEMNIFICATION

Each Sweepstakes entrant agrees to indemnify and hold harmless the Released Parties from and against any loss, damage or expense (including court costs and attorneys’ fees) that the Sponsor, and/or any of the Released Parties together with each of their parent, subsidiary, and affiliated companies, and each of its and their successors or assigns, may suffer or incur as a result or in conjunction or connection with the Sweepstakes, or the prizes awarded to any winner (including, without limitation, the receipt and/or use of said prizes).

13) AMENDMENTS

We reserve the right to suspend, cancel, terminate or modify the Sweepstakes without advance notice in the event we believe, in our sole discretion, that any computer virus, worms, bugs, tampering, spamming, unauthorized intervention, fraud, technical failures or other errors or problem beyond our control could corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, and thereafter to re-commence such Sweepstakes, if at all, only at such time(s) and upon such terms and conditions as we shall deem reasonable under the circumstances.

14) SEVERABILITY

If any one or more provisions of these Official Sweepstakes Rules are held to be invalid, illegal or unenforceable by a court of competent jurisdiction, such invalidity, illegality or unenforceability shall not affect the validity, effect or enforcement of any other provision or provisions of these Official Sweepstakes Rules.

15) FORCE MAJEURE

The failure of the Sponsor to comply with any provision of this Official Sweepstakes Rules due to an act of God, hurricane, war, terrorism, fire, riot, earthquake, actions of governmental authorities outside the control of the Sponsor or other force majeure event shall not be considered a breach of these Official Sweepstakes Rules.
